Illinois legislators introduce three cannabis delivery bills
Illinois legislators recently introduced three cannabis delivery bills that address licensing, drive-through windows, security, penalties and enforcement, and more.
Sen. Cristina Castro recently introduced Senate Bill 1966, which would add provisions permitting delivery by dispensaries to the residence of a qualifying patient, provisional patient, or designated caregiver and provide an exception to the prohibition for a dispensing organization to transport cannabis for delivery. SB1966 also, among other provisions, would remove prohibitions for a dispensing organization to operate drive-through windows, eliminate the distinction made between medical and non-medical uses, include age verification, adds provisions regarding an inventory control system, and contains provisions regarding dispensary security.
Rep. Bob Morgan recently introduced House Bill 2926, a dual cannabis delivery bill matching SB1966. HB2926 also would include all matching provisions from SB1966, including delivery, drive through, and age verification, security, and inventory control systems. A third delivery bill, House Bill 3074, introduced by Rep. Sonya M. Harper, would require the Department of Financial and Professional Regulation to issue cannabis delivery organization licenses with requirements and prohibitions for cannabis delivery organizations. HB3074 contains provision regarding applications for cannabis delivery organization licenses, requires IDFPR to develop a system to score applications, and provides that applicants must qualify as social equity applicants in order to be awarded a cannabis delivery organization license. The bill also requires that applicants pay a $500 application fee and a prorated fee of $500 prior to receiving a license, to be deposited into the Cannabis Regulation Fund. HB3074 also provides that cannabis delivery organizations may obtain cannabis products from any cannabis business organization licensed in the State and other provisions regarding, identification cards, background checks, renewals, and others.
