IDOA adopts fee amendment for cannabis infusers
In the latest issues of The Flinn Report, the Illinois Department of Agriculture (IDOA) adopted an amendment to correct “errors in the listed fees for modifications and alterations to licensed infuser facilities,” effective July 24, 2024.
The new rulemaking, originally proposed in The Flinn Report (April 19, 2024), stated, “(IDOA) proposed an amendment to the Part titled Cannabis Regulation and Tax Act correcting errors in the listed fees for modifications and alternations to licensed infuser facilities. For modifications to a license, a fee of $1,250 (decreased from $5,000) is due at the time of application, with an additional fee of $750 (decreased from $3,000) due upon approval of the application. For alterations to a facility that do not require an amendment to the license, the application fee is $250 (decreased from $1,000). IDOA will refund the excess portion of any fee paid by an applicant prior to 9/1/24 that was higher than the amounts listed in this rulemaking.”
The following provision also was added: “For any fee paid by a licensee prior to September 1, 2024 that was higher than the amounts identified in this Section, the Department shall refund the difference in fee paid prior to the reduction in the fee amount.”
