IDFPR announces confusing “Final Administrative Decision”
Last week, the Illinois Department of Financial and Professional Regulation sent out a press release with the heading “Final Administrative Decision” regarding applications for Conditional Adult Use Dispensing Organization Licenses. According to the IDFPR, “the statutory and administrative abandonment processes for each lottery, as provided by the Act and the Department’s rules, have been completed.”
On September 3, 2021, the IDFPR announced the following lists of results from the Qualifying Applicant Lottery (conducted on July 29, 2021), the Social Equity Justice Involved Lottery (conducted on August 5, 2021), and the Tied Applicant Lottery (conducted on August 19, 2021). The results from the three lotteries may be accessed at the following links:

The press release stated, “Conditional Licenses to be awarded by the Department following these lotteries may be subject to change as a result of compliance issues pursuant to section 15-30(g) of the Act, court orders, or administrative review.” The release also stated, “Pursuant to Section 15-175(a) of the Act, this Final Administrative Decision is subject to judicial review under the Administrative Review Law, 735 ILCS 5/3-102.”
