Illinois Sen. Kimberly A. Lightford introduced today a parallel Senate bill that mirrors House Bill 5784 (HB5784). Senate Bill 20 (SB20) also contains multiple cannabis-related amendments across several state acts, from CBD and hemp to licensing and operations.

The bill includes the following provisions and technical changes related to the creation of the Hemp Consumer Products Act:

1. sets forth provisions concerning definitions
2. prohibitions and compliance
3. applications and licensing for hemp consumer product manufacturers
4. requirements for licensees
5. registration of hemp consumer CBD products
6. requirements of hemp consumer CBD products
7. packaging and labeling of hemp consumer CBD products
8. testing requirements
9. marketing and sale of hemp consumer CBD products
10. penalties
11. the administration and enforcement of the Act and rulemaking, including emergency rulemaking, by the Department of Agriculture
12. and other matters

SB20 also includes the following provisions and technical changes to the Cannabis Regulation and Tax Act:

1. provides that a violation of provisions concerning unlicensed practice is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act
2. sets forth penalties for unlicensed practice as a cultivation center, infuser, or craft grower
3. sets forth provisions concerning the use of hemp in cannabis-infused products
4. allows a craft grower and infuser to purchase a hemp-derived intoxicating product from a hemp consumer product manufacturer and offer a hemp-derived intoxicating product for sale to another cannabis establishment, after which the product is considered cannabis and the craft grower or infuser must ensure the product meets all the requirements of the Act
5. and other changes

In addition, SB20 amends the Illinois Administrative Procedure Act, the Illinois Procurement Code, the State Finance Act, the Industrial Hemp Act, the Cannabis Control Act, and the Consumer Fraud and Deceptive Business Practices Act to make conforming changes.
